1. Introduction

These Terms and Conditions (“Terms”) govern your use of Lihv Assist (“the Service”), operated by Lihv (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Service Description

Lihv Assist is a clinical documentation and governance support tool designed for UK aesthetic practitioners. The Service provides assistance with clinical documentation, aftercare instructions, governance protocols, patient communications, and related content.

3. Important Disclaimers

Lihv Assist is not a medical device and does not provide medical advice. All content generated by the Service is for informational and documentation support purposes only. You are solely responsible for:

• Reviewing, verifying, and approving all generated content before use
• Ensuring all clinical decisions are made by qualified practitioners
• Complying with all applicable professional standards, regulations, and guidelines
• Maintaining appropriate professional indemnity insurance
• Anonymising patient data before entering it into the Service

We do not guarantee the accuracy, completeness, or suitability of any content generated by the Service. The Service should not be used as a substitute for professional clinical judgement.

4. Eligibility

The Service is intended for use by qualified aesthetic practitioners operating in the United Kingdom. By registering, you confirm that you are a qualified practitioner and are legally permitted to provide aesthetic treatments.

5. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

6. Subscriptions and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to:

• Pay the applicable subscription fees as displayed at the time of purchase
• Automatic renewal of your subscription at the end of each billing period
• Token-based usage limits as specified by your chosen plan

Payments are processed securely through Stripe. We do not store your payment card details. You may cancel your subscription at any time through your subscription settings. Cancellation takes effect at the end of the current billing period.

6.1 Free Trials

We may offer free trial periods on certain plans. During a trial, you will have full access to the plan features. Your payment method will be charged automatically at the end of the trial period unless you cancel before the trial expires.

6.2 Token Top-Ups

Additional tokens may be purchased as one-time top-ups. Top-up tokens are valid until the end of the current billing period and are non-refundable.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Enter identifiable patient data (names, NHS numbers, addresses, or other personal identifiers) into the Service
• Share your account credentials with others
• Attempt to reverse-engineer, copy, or redistribute the Service
• Use the Service to generate misleading or fraudulent clinical documentation
• Circumvent usage limits or security measures

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by Lihv. Content you generate using the Service belongs to you, but we retain the right to use anonymised, aggregated usage data to improve the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Lihv shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

We are not liable for any clinical outcomes, patient complaints, regulatory actions, or professional consequences arising from your use of content generated by the Service.

11. Service Availability

We aim to provide continuous access to the Service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or modifications that temporarily affect access. We will endeavour to provide reasonable notice of planned downtime.

12. Termination

We reserve the right to suspend or terminate your account if you breach these Terms. Upon termination, your right to access the Service ceases immediately. You may request export of your data within 30 days of termination.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
